  • Sick leave and family responsibility leave are not paid out on termination.
  • Declare the termination to the UIF on uFiling and give the worker a certificate of service.
Not legal advice. These tools and templates give general information based on Sectoral Determination 7, the Basic Conditions of Employment Act and official government guidance. They do not replace advice from a labour lawyer, the Department of Employment and Labour or the CCMA, and they do not take your particular circumstances into account. A dismissal also needs a fair reason and a fair procedure under the Labour Relations Act; this calculator does not cover that.

How final pay is worked out

  • Notice (SD7 clause 24): 1 week up to 6 months' service, 4 weeks after that. Not during the worker's leave.
  • Leave pay (clause 25): all untaken annual leave, plus pro-rata leave for the current cycle if employed longer than 4 months. We use the more generous of the two SD7 methods.
  • Paid time off owed for overtime or Sunday work by agreement.
  • Severance (clause 27): at least 1 week's pay per completed year, for dismissal for operational requirements.

What to give the worker

  • A written notice of termination, explained in a language they understand.
  • A final payslip showing every amount.
  • A certificate of service: names, employer address, start and end dates, job, wage at termination and, if the worker asks, the reason for leaving.
  • An updated UIF record on uFiling, so the worker can claim unemployment benefits.

Frequently asked questions

What notice must I give a domestic worker?

1 week if they have worked for you for 6 months or less, and 4 weeks after that. The same applies when the worker resigns. Notice must be in writing.

Can I pay the notice period instead?

Yes. You may pay the worker what they would have earned during the notice period instead of having them work it.

Is leave paid out when employment ends?

Untaken annual leave is paid out. If the worker was employed for longer than 4 months, you also pay pro-rata leave for the current leave year: one week's wage per 4 months worked, or one day per 17 days worked. Sick and family responsibility leave are not paid out.

When is severance pay due?

When you end the employment for operational reasons, for example because you no longer need a worker or are moving. It is at least one week's pay for each completed year of service. It is not due on resignation or dismissal for misconduct.

My worker lives in. Do they have to leave immediately?

No. If you end the employment without the worker working the notice period, you must provide accommodation for 1 month, or until the notice would have ended if later.
